And if it is not legal then why are they not punished, or if you see, can they be punished. Many such questions come up. Amidst all this, Kerala High Court has recently given a decision in which it has been told whether watching porn alone is a crime or not. Kerala High Court has said that watching porn silently alone is not a crime of obscenity.

In fact, the Kerala High Court has recently canceled the criminal proceedings initiated against a person. All this happened when the accused was arrested by the police from the roadside for watching obscene videos on his mobile phone. Hearing the petition of the accused, Justice P.V. of Kerala High Court. Kunhikrishnan said that watching porn videos alone does not constitute a crime under obscenity.
Not an offense under IPC section 292
He has said in his judgment that the question to be decided in this case is whether watching porn videos in one’s private time without showing it to others comes under the category of crime? A court of law cannot declare that it amounts to a crime for simple reasons. This is their personal choice and interfering in it is tantamount to interfering in their privacy. Viewing obscene photos by someone in one’s privacy is not an offense under Section 292 of the IPC.
It was also stated in the judgment that watching obscene videos from a mobile phone in one’s privacy is also not a crime under Section 292 of the IPC. If the accused is trying to broadcast or distribute or publicly display any obscene video or photograph then only the offense under section 292 of the IPC is committed.
